Phosphor Gallery respects the privacy of its customers.
Customer's have three types of information on file with the gallery -- business related information, information intended for display, and other information. These types will be covered separately. Customers should also review the Visitor Privacy Policy. ![]() ![]() Information Collected: Customers must provide a completed application form to the gallery. The information on this form is Business Information. Business Information includes, but is not limited to, credit card numbers, postal addresses, phone numbers, and email addresses. Use of Information: Phosphor gallery will never use any information for unsolicited direct advertising including marketing emails (spam) or phone calls. Business information is used for identification, billing, to reply to customer inquiries, addressing customer concerns, notifying customers of changes in policies, evaluating the website's design, evaluating the effectiveness of advertisements, and similar business purposes. Distribution of Information: Phosphor Gallery will not sell, rent, or give a customer's Business Information to any other business or agency except as follows; o   If a customer submits any information for display on the website then the information may be displayed even if it is Business Information. o   The gallery will provide necessary information to its personnel, banks and other businesses or institutions as is needed to effect payment, refunds, or other actions related to the gallery's normal operation as a business. o   The gallery reserves the right to provide any information in its records to lawyers or other entities who are representing it in court and to use the information in court. o   The gallery will cooperate fully with any request for information for official use by a U.S. local, state, or federal law enforcement officer or government agency. All information requested will be provided. o   The gallery reserves the right to offer any related information to U.S. local, state, or federal law enforcement officers if the information may be related to a crime or used to prevent a crime. o   If ownership of the gallery is ever transferred to another person or business then the new owner must agree to apply Phosphor Gallery's privacy policy to all personal information in the gallery's records at the time of transfer. Options: The gallery will provide a copy of a customer's Business Information to the customer upon request. The gallery will remove or update a customer's Business Information upon request unless the information is needed for business or tax purposes, or its retention is required by law. An explanation will be provided if such a request is not carried out. Display Information ![]() Overlap of Business Information and Display Information: If a customer submits any of his Business Information for display then the submitted information may be displayed in the gallery. This is not an infringement of privacy since the customer has requested that the information be displayed. Information Collected: Any information which the customer submits for display may be kept in the gallery's records. Typically, this includes the images of artwork, descriptions and other data related to it and the customer's biography and contact information. An artist's name is Display Information. Use of Information: Phosphor Gallery uses this information to determine if the material is suitable for display and to display it on the website. Distribution of Information: Phosphor Gallery may display this information on its website if all standards and requirements are met. Options: The customer may have the information which he submitted for display modified or display stopped by communicating with the gallery through customer service. Display Information will be removed from gallery records on request except for that needed for business records or legal requirements. Such actions will be carried out within the normal operating cycle of the gallery. Other Kinds of Information ![]() Note that questions asked by customers may be published anonymously, possibly edited or composited, on the web site. ![]() This policy may be changed at any time. Policy changes will become effective thirty days after a notice is published on this web site. Changes apply only to information collected after a change. This policy became effective on 3/23/04. |
